Arbiter-in-Chief??

I am certainly glad for the President’s concern regarding the BP oil spill–even though it may be too little too late–but, demanding a private company set up escrow accounts and other such action is over the top even for the “bully pulpit.”  Am I the only one, or is this kind of action supposed to be a judicial issue?  And then, what about “due process?”  This whole thing appears really whacked to me.  Has our Constitutional framework and freedoms been set aside?  Since when does the executive branch usurp judicial functions and become prosecutor, judge, and jury?  Yes, this is a huge environmental crisis but does it require martial law? The line between public and private sectors seems to be all but erased as the Commander-in-Chief has added yet another title to his job description.
